The Australia house
Also: the Australia house, Gold Coast rental
Intro
The Australia house was the Gold Coast rental Depp occupied in early 2015 while filming Pirates of the Caribbean: Dead Men Tell No Tales. Heard joined him there in March. On the night of March 7–8 the tip of Depp's right middle finger was severed in the kitchen on the main floor — an event testified to at greater length, and from more competing angles, than any other in the case. Depp's account: Heard threw a vodka bottle that shattered and cut him. Heard's account: Depp severed his own finger during a rage and, over the same stay, subjected her to a multi-day assault including sexual violence for which she did not seek medical treatment or photographs. Dr. David Kipper flew in from Los Angeles; Depp was taken to Gold Coast University Hospital, and surgeon Dr. David Kulber later reconstructed the fingertip. Ben King, Depp's estate manager, testified to the state of the house afterward. Audio of Depp discussing the injury was entered as Plaintiff's Exhibit 343; writing on the walls in black and red lipstick — authorship disputed — was entered as Defendant's Exhibit 375.
Key Moments (56)
Christi describes a late dinner with Heard after Australia: Heard told her to 'get down off my cross and mind my own business' and said Jerry Judge and Christi needed to stay out of her marriage. Christi testifies she was sitting directly next to Heard and saw no marks or discoloration on her face.
Day 1 · Direct of Christi Dembrowski
Rottenborn introduces Exhibit 348, a February 27 2015 email from Christi to agent Tracey Jacobs, which records Depp being two and a half hours late one day and seven hours late on another during Pirates 5 filming in Australia. Christi cannot confirm whether 'he told me' in the email referred to Depp himself.
Day 2 · Cross of Christi Dembrowski
Anderson testifies that Depp never spoke about his finger injury before June 18, 2016, and that she only observed an injury to his finger during that session.
Day 3 · Redirect of Laurel Anderson
Kipper describes finding Depp outside the Australia house on March 7, 2015 — part of his finger missing, the house in disarray with things thrown around, and what appeared to be blood on the wall rather than paint.
Day 3 · Direct of David Kipper
Kipper recounts the March 2015 Australia finger injury. He went inside the house to instruct staff to search for the fingertip, which was found in the kitchen. He saw blood around the home and broken glass in the kitchen but observed no injuries to Heard.
Day 4 · Cross of David Kipper
Kipper confirms the fingertip was found in the kitchen on the main floor of the Australia house.
Day 4 · Redirect of David Kipper
Kipper confirms he kept only summary notes of his Australia treatment — no contemporaneous detailed records.
Day 4 · Recross of David Kipper
After learning of the March 2015 finger injury in Australia, Lloyd and Dr. Kipper went to the rental house and found it in disarray—writing on the walls and a smashed TV. Lloyd did not recall seeing Heard that day.
Day 4 · Direct of Debbie Lloyd
March 7, 2015 nursing notes document the Australia finger injury notification and post-ER conversation in which the medical team advised Depp to stay away from Heard, characterizing the relationship as 'toxic.' Lloyd confirms she held that view based on Depp's disclosures.
Day 4 · Cross of Debbie Lloyd
Lloyd cannot recall whether Depp was drinking during the Australia trip.
Day 4 · Recross of Debbie Lloyd
Lloyd confirms she observed Heard drink in front of Depp during the Australia period.
Day 4 · Recross of Debbie Lloyd
Rottenborn establishes the scope of Bett's absence: not in Australia (March 2015), not on the Boston–LA flight (May 2014), not in the Bahamas, not in Tokyo — limiting his personal knowledge to LA-based events only.
Day 5 · Cross of Sean Bett
Wyatt testified Pirates 5 production was suspended two to three weeks because Depp's fingertip was cut off and he had to return to Los Angeles. After Depp returned to Australia, Disney executive Sean Bailey visited the set and had a friendly conversation about future collaboration.
Day 5 · Direct of Keenan Wyatt
Bredehoft challenged Wyatt on Depp's frequent lateness in Australia and the production shutdown duration after the finger injury. Wyatt acknowledged significant delays but denied knowing causes, including a suggested Marilyn Manson binge.
Day 5 · Cross of Keenan Wyatt
Depp recounts the Australia incident: a postnup argument escalated, Heard threw two vodka bottles — the second severing the tip of his right middle finger. In shock, Depp wrote on the walls in his own blood; he later lied to the ER, claiming the injury came from an accordion door.
Day 6 · Direct of Johnny Depp
Plaintiff's Exhibits 145 and 144 admitted: a photo showing a cigarette burn on Depp's cheek (Heard stubbed out his cigarette during the Australia incident) and a graphic photo of the severed finger taken in the emergency room.
Day 6 · Direct of Johnny Depp
Audio Exhibit 343 played in four clips. Clips include Heard acknowledging Depp hid in bathrooms in Australia to escape fighting, Heard stating throwing pots and pans is irrelevant to whether Depp should answer the door, and Heard admitting I did start physical fights.
Day 6 · Direct of Johnny Depp
March 7, 2015 texts requesting 'whitey stuff' and 'E business' shown; UK transcript read in which Depp conceded asking for cocaine and ecstasy immediately after finger injury.
Day 7 · Cross of Johnny Depp
King describes two London arguments: the first involved shouting and a delayed departure; the second began when Heard accusatorially asked Depp 'Why did you take your hand away from me, Johnny?' — establishing a pattern of provocation followed by Depp retreating that King observed in both London and Australia.
Day 8 · Direct of Ben King
Summoned to the Australia house on Sunday March 8, King arrives to find Heard in hysterical, uncontrollable crying attended by Jerry Judge, while Dr. Kipper is searching the kitchen bin.
Day 8 · Direct of Ben King
Nadelhaft established that King could not confirm when Heard arrived in Australia — possibly March 5 — and could not specify any arguments between Heard and Depp before March 8, limiting his basis for testimony about conditions preceding the finger injury.
Day 8 · Cross of Ben King
Defendant sought to play audio recordings (Exhibits 378A and 380) captured during the Australia cleanup, featuring the voice of security chief Jerry Judge. After a sidebar, the court sustained the hearsay objection on both exhibits, noting Judge was deceased and no foundation could be laid.
Day 8 · Cross of Ben King
King acknowledged he took more than ten photos of the Australia damage but provided only a subset to Depp's counsel for both the UK trial and this case. He could not recall how many were given, whether all were requested, or who specifically asked for them, and confirmed he still retains additional photos on his device.
Day 8 · Cross of Ben King
Moniz rehabilitates the Australia photos by drawing out King's explanation of his habitual documentation practice, including reference shots of room setups and notes Depp left for Heard in London.
Day 8 · Redirect of Ben King
Plaintiff's Exhibit 159 (multi-page Gold Coast house floor plan) introduced and published to the jury. King marks the master tub location on the top floor and confirms he observed no blood there.
Day 8 · Redirect of Ben King
Australia finger-injury day: Connolly arrives at Depp's accommodation to chaos — screaming, Heard irate and berating Depp — and works to extract him. After multiple attempts Depp is removed; Connolly administers first aid on a severely shattered finger at his apartment, then calls Nurse Debbie and Dr. Kipper.
Day 11 · Direct of Malcolm Connolly
Connolly describes Heard's demeanor during the Australia extraction as 'crazy, fierce,' and recalls her last words verbatim as Depp was removed from the property.
Day 11 · Direct of Malcolm Connolly
Nadelhaft establishes that Connolly was not seeing Depp daily in Australia, does not know whether Marilyn Manson was present, cannot confirm when Amber arrived, and acknowledges the security team was 25–40 minutes from the house.
Day 11 · Cross of Malcolm Connolly
Moniz asks how close Connolly was to Heard in Australia; Connolly estimates three to four feet during the egress, for about 15-20 seconds.
Day 11 · Redirect of Malcolm Connolly
Rottenborn systematically establishes Jenkins was not present at any of the key disputed locations or incidents: Orange Avenue March 2013, Hicksville Trailer Palace June 2013, Boston-to-LA flight May 2014, Bahamas August 2014, Tokyo January 2015, Australia March 2015, Thanksgiving at Penthouse 5 November 2015, Bahamas December 2015, ECB December 15 2015, or the penthouse on May 21 2016. Jenkins concedes he has no personal knowledge of what went on between Depp and Heard behind closed doors.
Day 11 · Cross of Starling Jenkins III
McGivern establishes his nine-year history with Depp, describes the couple's dynamic as initially positive but increasingly volatile, and identifies the Australia return in March 2015 as the inflection point when arguments became near-nightly.
Day 12 · Direct of Travis McGivern
Falati recounts the Australia incident through her March 2015 nursing notes: Heard returned to LA accompanied by house manager Ben while Depp remained in Australia, and Falati recalls hearing Depp's finger was injured, though she was not present.
Day 12 · Direct of Erin Falati
Falati confirmed she met Heard the day after Heard returned from Australia in March 2015 and observed no injuries. She stated she did not recall any injuries and would have documented visible injuries in her notes — notes that contain no such record.
Day 13 · Cross of Erin Falati
Exhibit 14, a March 9, 2015 email from Dr. Kipper, was introduced. It instructed Falati to give Heard a fabricated 'excuse' — that Depp needed quiet time for medication balancing — to keep Heard from seeing Depp. Dr. Kipper added that 'none of this will be accepted by her.' Falati confirmed her general understanding that a major argument had occurred in Australia and the treatment team had decided to separate the couple.
Day 13 · Cross of Erin Falati
Hughes details the specific violence reported by Heard: physical violence including pushing, slapping, choking, and kicking; extensive coercive control over Heard's acting career, wardrobe, and personal contacts; and multiple incidents of sexual violence including the Australia bottle penetration, the Hicksville 'cavity search,' and a Bahamas closet assault.
Day 13 · Direct of Dawn Hughes
Bredehoft plays three additional segments of the June 2016 audio recording beyond what cross presented. Depp is heard acknowledging a physical fight during the Australia honeymoon and stating he left to avoid further 'physical abuse on each other.'
Day 14 · Redirect of Dawn Hughes
Australia March 2015 three-day incident core narrative — MDMA, bottle smashed on floor, strangulation against bar, alleged penetration with bottle and severed fingertip aftermath
Day 15 · Direct of Amber Heard
Vasquez introduces Mortdecai premiere Tokyo photos (1256, 1257, 1258) showing Heard in a backless dress with no visible marks after the claimed kneeling-on-back incident. She then establishes Heard sought no medical treatment and took no injury photos during the Australia trip despite claiming rape, cuts on forearms and feet, and a bruised jaw.
Day 16 · Cross of Amber Heard
Plaintiff's 343 audio played: Depp saying he went to 'at least five bathrooms and two bedrooms' to escape in Australia, with Heard on the tape arguing about escape from the fight — Vasquez uses it to contend Heard was the aggressor who injured Depp's finger.
Day 17 · Cross of Amber Heard
Pennington describes deep cuts on Heard's forearms and feet seen immediately after Australia, but confirms she was not present and her understanding of the cause comes solely from what Heard told her.
Day 18 · Direct of Raquel Pennington
Pennington testifies that Depp told her — and showed her — that he had cut off the tip of his own finger in Australia, directly contradicting any attribution of the injury to Heard.
Day 18 · Cross of Raquel Pennington
Vasquez establishes that Sexton first learned of the Australia bottle penetration allegation only after informally meeting with Heard's attorneys and before her formal deposition in August 2019, pinning the disclosure to a post-attorney-contact window.
Day 18 · Cross of Kristina Sexton
Sexton denies being told that Heard threw a bottle at Depp in Australia. She says Heard described Depp breaking a bottle himself and accidentally cutting his finger from it.
Day 18 · Cross of Kristina Sexton
Later notes show Depp's self-described 'paranoia' (defined as fear, envy, and vigilance), a 'big fight with girlfriend yesterday' entry from 12/18/14, and jealousy themes. Last session was 1/8/15, after which Depp left for Australia.
Day 19 · Direct of Alan Blaustein
Core opinion stated: Depp's finger injury did not result from a vodka bottle being thrown at him. Moore answers 'No' over a leading objection that is overruled.
Day 20 · Direct of Richard Moore
Moore concedes he was not present in Australia, has no personal knowledge of how the injury was sustained, never personally examined Depp's finger, and provided no medical treatment in connection with the injury — establishing the bounds of his opinion as purely records-based.
Day 20 · Cross of Richard Moore
Bredehoft displays three Australia photos (Exhibits 1828, 1829, 1830) and asks Spiegel to link them to IPV perpetrator risk factors. A sidebar results in the court reminding Bredehoft to confine Spiegel to risk-factor framing rather than direct abuse conclusions. Spiegel's final answer identifies evidence of 'more than average degree of violence' and psychological abuse consistent with the risk-factor framework. Spiegel also confirms no record evidence of Heard writing on walls or painting over canvases.
Day 20 · Redirect of David Spiegel
Court sets definitive scope for Kulber testimony: surgery performed, pin placed, skin graft, and soft cast only. Depp's team concedes it will not ask about the cause of the finger injury after the judge's direct instruction.
Day 21 · Colloquy
Depp describes flying back from the Hollywood Vampires' Rock in Rio show so Heard could audition for Aquaman, then personally calling Warner executives Tsujihara, Kroll, and Silverstein on her behalf. Multiple sidebars address limits: Australia dog-visa issue kept out; hearsay objections sustained on what executives said but overruled on the outcome.
Day 22 · Direct of Johnny Depp
Depp denies consuming 8-10 MDMA pills at once in Australia, testifying he had used MDMA only six or seven times in his life and that the quantity Heard described would be fatal.
Day 22 · Direct of Johnny Depp
Meyers introduces photos of the Australia bar (Def. Exhibits 1817, 1820); Depp draws on the touchscreen to show positions during the bottle incident and identifies blood on the floor from his severed fingertip. A sidebar results in the judge allowing Depp's statement to Dr. Kipper (Def. Exhibit 394) as a prior consistent statement rebutting cross-examination impeachment.
Day 22 · Direct of Johnny Depp
Depp denies recalling any drug requests after his finger injury, but Rottenborn produces Exhibit PX393 — a text to personal assistant Nathan Holmes reading 'Need more whitey stuff ASAP, brother man and the E business' — which Depp acknowledges was sent shortly after hospital admission.
Day 22 · Cross of Johnny Depp
Rottenborn challenges whether the broken glass visible in the Australia bar photo constitutes a full handle of vodka as Depp claimed; Depp ultimately concedes he does not see the handle in the photograph.
Day 22 · Cross of Johnny Depp
Exhibit 1821 (Australia bar photo) and Exhibit 1820 (wall phone photo) are revisited. Depp acknowledges he can now see a telephone behind the bar in Exhibit 1821 but maintains he did not recall it being there — a partial concession on cross-examination testimony.
Day 22 · Redirect of Johnny Depp
Gilbert concedes he is not offering an expert opinion on what actually caused the finger injury, limiting the scope of his testimony.
Day 23 · Cross of Richard Gilbert
Audio clip played of Depp stating 'the day that I chopped my finger off,' used to contradict his trial testimony that Heard caused the Australia finger injury.
Day 24 · Closing_argument
Quotes From The Record (39)
“she told me that I needed to basically get down off my cross and mind my own business. She said that Johnny liked that she was feisty.”
— Christi Dembrowski
Christi's account of Heard dismissing her concern about the couple's fighting after Australia, framing it as Heard rejecting outside intervention.
“We certainly didn't want any press to know about it. So that's - you know, to keep it from that.”
— Christi Dembrowski
Christi acknowledges coordinating a press-management effort around Depp's finger injury, which Depp's team attributed to Amber and which is central to the Australia incident narrative.
“No. Because I would have written it when he first mentioned it to me.”
— Laurel Anderson
Anderson explains her confidence that the finger injury was not discussed before June 18, 2016, grounding the timeline in her note-taking practice.
“There were things on the floor. There were things that had been thrown around, it looked like. There were just things were out of order in that house.”
— David Kipper
Kipper's firsthand description of the Australia house condition on March 7, 2015 corroborates a scene consistent with a violent altercation.
“it did look, to me, like there was blood on the wall, not an actual painting.”
— David Kipper
Kipper's direct observation of blood on the Australia house wall is a key piece of contemporaneous evidence in the disputed finger-injury incident.
“Yes. I went in to instruct one of the people with him to look for the tip of the finger, hoping that we would be able to put it back.”
— David Kipper
Establishes the purpose and limited scope of Kipper's entry into the Australia house the day of the finger injury.
“There was blood around the home, as I have previously mentioned, but I didn't specifically see blood on glass.”
— David Kipper
Confirms physical chaos at the Australia house while drawing a narrow distinction — blood was present but not specifically on the broken glass in the kitchen.
“Other than the summary notes, no.”
— David Kipper
Confirms the absence of detailed contemporaneous records from the Australia visit, limiting the documentary trail.
“I believe so.”
— David Kipper
Kipper's qualified affirmation that Lloyd heard Depp's explanation of the finger injury positions her as a corroborating witness to that account.
“I had heard that Amber threw a bottle of vodka at him I had heard that he slammed it with a phone.”
— Debbie Lloyd
Lloyd's account of the two conflicting explanations she heard for how Depp's finger was injured in Australia.
“It was a mess.”
— Debbie Lloyd
Lloyd's initial description of the Australia rental house on the day of the finger injury, before elaborating on writing on the walls and a smashed TV.
“MD offered patient Valium 10 milligrams IM to help with his anxiety and anger, but patient refused.”
— Adam Nadelhaft
Lloyd's own notes document Depp's anger during the Australia incident, corroborating the volatile atmosphere described by other witnesses.
“Patient was talking about wanting to drink alcohol but did not obtain any.”
— Adam Nadelhaft
Documents Depp's substance cravings in the days following the finger injury, from Lloyd's contemporaneous nursing record.
“Yes.”
— Debbie Lloyd
Lloyd confirms she saw Heard drink in front of Depp during the Australia trip.
“I looked down and realized that the tip of my finger had been severed, and I was looking directly at my bones sticking out”
— Johnny Depp
Depp's first-person account of the moment he discovered the extent of the Australia injury, central to the physical evidence in the case.
“Why did you take your hand away from me, Johnny? Do you love me anymore?”
— Ben King
King recounts the exact words Heard used to trigger the second London argument, establishing the provocative pattern he observed in both London and Australia.
“I can't leave. I can't leave. It will be the end if I leave.”
— Ben King
Heard's words resisting departure from Australia after the March incident, suggesting anxiety about the relationship rather than concern for her safety.
“Wrapped. I mean, it was loosely wrapped. The paper was open by that point, the blood had dried up and it was sitting in this sort of nest of this paper.”
— Ben King
King's own description of how the severed fingertip was found — the detail of dried blood and the 'nest' of paper is a precise contemporaneous observation central to the Australia injury narrative.
“Dr. Kipper told me he sustained an injury on one of his fingers.”
— Ben King
Establishes that King's knowledge of the finger injury came solely from Dr. Kipper and was limited to the fact of an injury — not its cause — supporting Nadelhaft's line that no one told King how the injury occurred.
“I take photos as points of reference”
— Ben King
Establishes photo-taking as a longstanding professional habit, contextualizing the volume of Australia damage photos.
“that's where the Stolichnaya bottle was, below that bar, by the barstools”
— Ben King
Places a specific piece of physical evidence at the lower-ground bar scene in Australia.
“Yeah. Just fuck off with your guys, you're a fucking coward, like you always do.”
— Malcolm Connolly
Verbatim recall of Heard's final words as Connolly removed Depp from the Australian accommodation on the day of the finger injury.
“What you are and who you are and how you fucked me over and make me feel sick of myself There's still a lot left in the day. Maybe you should dye your hair. I see roots.”
— Johnny Depp
The played audio clip of Depp in the Australia house captured his emotional and verbal state — Connolly confirmed it reflected what he witnessed.
“Best way to do this is think about it, okay? 15 seconds, 20 seconds.”
— Malcolm Connolly
Connolly's own estimate of how briefly he observed Heard during the Australia incident, contextualizing the limits of his observation.
“I just remember Mr. Depp's finger was injured. I can't tell you specifically which one, but I remember there was an injury to his finger.”
— Erin Falati
Falati's second-hand recollection of the Australia finger injury, consistent with Depp's account but offering no detail as to cause.
“Safe? No, she's not. Kept saying she wants to kill herself”
— Adam Nadelhaft
Nadelhaft reading Whitney Heard's March 23 2015 text to Falati, documenting Amber's suicidal statements to contemporaneous witnesses during the Australia aftermath period.
“No, I don't recall. I don't make note of it, but I don't recall either.”
— Erin Falati
Falati confirmed she neither recalled nor documented any injuries when she met Heard the day after Heard returned from Australia — a key absence supporting Depp's team's argument that Heard's injury claims were overstated.
“I don't recall specifics. I wasn't present in Australia at that time. I just remember a general sense of a big argument happening and the treatment team deciding that they should not be around each other.”
— Erin Falati
Confirms a serious enough incident in Australia that the treatment team intervened to separate Depp and Heard, while establishing that Falati had no direct knowledge of what occurred.
“I don't see him anymore. I don't see him anymore. It wasn't him It was black.”
— Amber Heard
Heard's description of Depp's eyes during the alleged Australia strangulation — central sensory detail of her core assault narrative
“He said that he would fucking kill me. He said, "I'll fucking kill you."”
— Amber Heard
Heard's testimony about what Depp said during the alleged bottle penetration in Australia
“I have never testified to a sequence.”
— Amber Heard
Heard's attempt to escape the locked-in order of phone-smash → finger loss → bottle assault that Vasquez reads back from her direct testimony — frames the Australia sequence dispute.
“She had these deep cuts on the backs of her forearms and-yeah, they were very, very deep, long cuts on the backs of her forearms.”
— Raquel Pennington
Pennington's firsthand description of injuries she attributed to the Australia incident, establishing her as an eyewitness to the aftermath.
“No. She had told me that he had broken a bottle and then cut himself with the bottle that he had broken.”
— Kristina Sexton
Sexton relays Heard's version of the Australia finger injury — Depp broke the bottle himself — directly contradicting Depp's account that Heard threw the bottle at him.
“Big fight with girlfriend yesterday. Struggling with how to separate.”
— Alan Blaustein
Session note from 12/18/14 documenting ongoing conflict and Depp's difficulty managing the relationship, contemporaneous evidence of volatility shortly before the Australia trip.
“any mechanism that squeezes the finger between two hard, opposing surfaces could create this type of injury.”
— Richard Moore
Implicitly frames the actual injury as a crush between surfaces — not a bottle impact — pointing toward a different account of what happened in Australia.
“did you consider Dr. Kipper's deposition testimony that while Dr. Kipper was providing emergency treatment for Mr. Depp's finger injury in Australia in the driveway of the house, Mr. Depp told him that his finger was injured when Ms. Heard threw a vodka bottle at him?”
— Camille Vasquez
Surfaces a contemporaneous account by Depp's treating physician — a category of evidence Moore acknowledged reviewing — that Moore said he did not recall, suggesting gaps in his pre-testimony review.
“He could attempt to grab someone. I don't know how successful he would be. He had his index finger free and his thumb free, but the other fingers were probably not being able to move.”
— David Kulber
Key factual answer on Depp's hand capability while in the post-surgical cast, relevant to disputed conduct during the Australia period.
“Because I'd be dead. I'm pretty sure I'd be dead. I think one would die, yes. Probably rather quickly.”
— Johnny Depp
Depp rebuts Heard's claim he consumed 8-10 MDMA pills at once in Australia by arguing it would have been fatal.
“I'm talking about Australia, the day that I chopped my finger off.”
— Johnny Depp
Audio clip of Depp admitting he self-inflicted the finger injury, played to contradict his trial testimony attributing it to Heard.
