[Section Header]: ELIZABETH MARZ, being first duly sworn, was examined and testified as follows:

30

[SECTION HEADER]: EXAMINATION BY COUNSEL FOR THE PLAINTIFF AND

31 6:40:44

MS. VASQUEZ: Please state your full name fur the record

32 6:40:47

ELIZABETH MARZ: Elizabeth Rae Marz.

33 6:40:48

MS. VASQUEZ: Between the time that you lived in New York, say, 2012, through 2015, --

34 6:40:52
35 6:40:55

MS. VASQUEZ: How many times, would you say, you saw Ms. Heard?

36 6:41:00

ELIZABETH MARZ: I don't remember.

37 6:41:02

MS. VASQUEZ: More than four times?

38 6:41:07
39 6:41:09

MS. VASQUEZ: In 2015 and '16, do you recall how close you and Ms. Pennington were as friends?

40 6:41:17

ELIZABETH MARZ: Yeah. We ,'ere pretty close. Pretty close, uh-huh.

41 6:41:21

MS. VASQUEZ: In your previous testimony, I'll I represent to you, Ms. Marz, that you testified that, at least in July in 2016, you would b communicate with Ms. Pennington weekly.

42 6:41:31

ELIZABETH MARZ: I don't remember. Maybe at that time, perhaps we were communicating. Like I said, there were times we communicated weekly or daily.

43 6:41:38

MS. VASQUEZ: You'd agree with me that you'd remember something significant, like one of your girlfriends telling you, somebody you've known since Texas, when you were a young girl, you ! 11 remember that her husband or fiance or boyfriend was beating her.

44 6:41:56

MS. VASQUEZ: You would remember that, correct?

45 6:41:58

MS. VASQUEZ: And your testimony is that you only lived at the Eastern Columbia Building in February ! 16 of 2016 for two weeks?

46 6:42:03

ELIZABETH MARZ: It was around two weeks. I don't know I the specific amount of time, but it was definitely less -- a little over two weeks, less than a month I and, yes.

47 6:42:14

MS. VASQUEZ: And when you stayed at the Eastern Columbia Building, did you stay in one of the I I penthouses?

48 6:42:16
49 6:42:18

MS. VASQUEZ: Okay. And did you understand that that penthouse was owned by Mr. Depp, at the time?

50 6:42:24

ELIZABETH MARZ: I assumed it was, yes.

51 6:42:26

MS. VASQUEZ: Okay. And for what purpose did you go to the Eastern Columbia Building on May 21st, 2016?

52 6:42:32

ELIZABETH MARZ: To assist Raquel in getting ready or a jlO bead show that she was going to be doing the ! ll following day.

53 6:42:40

MS. VASQUEZ: Did you ever see Mr. Depp be violent ! 13 towards anyone?

54 6:42:46

ELIZABETH MARZ: I experienced him that night as - like, I was personally, I was scared of him. So, and that's all I can say from the moment that - the one interaction I had with him that night, it was frightening to me. His behavior was frightening to me.

55 6:43:07

MS. VASQUEZ: She wouldn't wear makeup?

56 6:43:09

ELIZABETH MARZ: I mean, I don't think of her as someone who wears a lot of makeup, no.

57 6:43:14

MS. VASQUEZ: You've known her a long time?

58 6:43:16
59 6:43:16

MS. VASQUEZ: She's never been somebody that wears a lot of makeup, correct?

60 6:43:19

ELIZABETH MARZ: Exactly. Unless she's going to something she needs to put makeup on for.

61 6:43:23

MS. VASQUEZ: So other than that, she's usually barefaced and beautiful?

62 6:43:25
63 6:43:27

MS. VASQUEZ: So it's your recollection, your best recollection, that Ms. Pennington was with you in penthouse 5 and never left with Ms. Heard before Mr. Depp arrived; is that correct?

64 6:43:39

ELIZABETH MARZ: Correct.

65 6:43:40

MS. VASQUEZ: So you hear some type of commotion, you don't know where it's coming from, correct?

66 6:43:45

ELIZABETH MARZ: It sound like - yes, I mean, it sounds like it's coming from - we hear commotion and then it feels like it's getting closer and closer and closer.

67 6:43:54

MS. VASQUEZ: Did it sound like voices or did it sound like destruction?

68 6:44:02

ELIZABETH MARZ: It sounded like voices and destruction.

69 6:44:05

MS. VASQUEZ: But the door was abruptly opened?

70 6:44:07

ELIZABETH MARZ: Correct. Abruptly opened.

71 6:44:10

MS. VASQUEZ: Okay. So you hear the commotion. It feels like it's getting closer and closer.

72 6:44:12

ELIZABETH MARZ: Uh-huh.

73 6:44:14

MS. VASQUEZ: What happened next?

74 6:44:17

ELIZABETH MARZ: Then, you know, after the door slammed open and then Johnny came, like, bursting through O the door.

75 6:44:23

MS. VASQUEZ: Who opened the door?

76 6:44:26

ELIZABETH MARZ: Johnny.

77 6:44:27

MS. VASQUEZ: Was Johnny alone?

78 6:44:28

ELIZABETH MARZ: There was the two men behind him

79 6:44:31

MS. VASQUEZ: Okay.

80 6:44:31

ELIZABETH MARZ: Following.

81 6:44:32

MS. VASQUEZ: So Johnny opens the door. He's got his two, what we'll assume are his bodyguards, with him.

82 6:44:39

MS. VASQUEZ: What happens next?

83 6:44:42

ELIZABETH MARZ: So, it all happened very fast. He basically, the door kind of burst open and he came y in very, just, from my perspective, really under the influence of something, drugs or alcohol, because he was very sloppily, like, he looked wasted. He was holding a very large bottle of wine, looked like some sort of magnum bottle of wine, which was spilling all over the place. And as he opened the door, what I remember was he mumbled, "get your bitch out of here." And I just remember it all happened very fast. Like the door slamming open, him saying get your bitch out of here, the wine, that whole, you know, his way -- his whole being really frightened me. I almost felt like he was coming towards me, from my perspective. Whether he was coming towards me or not, it scared me, and I just ran out past him.

84 6:45:38

MS. VASQUEZ: You said Mr. Depp appeared to be either I drunk or high; is that correct?

85 6:45:44

ELIZABETH MARZ: He was -- seemed to be intoxicated.

86 6:45:48

MS. VASQUEZ: Okay. Is that different than drunk?

87 6:45:51

ELIZABETH MARZ: No. I mean, yeah, I guess. Yeah, he definitely seemed like he was under the influence of something.

88 6:45:57

MS. VASQUEZ: And on May 21st, 2016, how was Mr. Depp's demeanor different?

89 6:46:04

ELIZABETH MARZ: He was - it was a much more sloppy and all over the place and frightening and - yeah, Is combative. Yeah, felt very angry. He felt angry. And-yeah.

90 6:46:29

MS. VASQUEZ: And when you say "combative," what was combative, specifically about his demeanor? h 19

91 6:46:34

ELIZABETH MARZ: Just the way he burst through the room, O just very forcefully, and rushed in the room very quickly, just made me want to run out and past him quickly. It wasn't- it was very-yeah, it was intense.

92 6:46:49

MS. VASQUEZ: Okay. So Mr. Depp comes through the I door, to penthouse 5, and you hear him say I something to the effect of get your bitch out of here, correct?

93 6:46:57

ELIZABETH MARZ: Uh-huh.

94 6:47:05

MS. VASQUEZ: And then you ran out immediately 1120 thereafter?

95 6:47:07
96 6:47:09

MS. VASQUEZ: Did you see Mr. Depp spill any wine in penthouse 5 before you ran out?

97 6:47:18
98 6:47:19

MS. VASQUEZ: How much wine did you see him spill?

99 6:47:21

ELIZABETH MARZ: I don't remember.

100 6:47:24

ELIZABETH MARZ: Lot? The entire bottle?

101 6:47:25

ELIZABETH MARZ: Not the entire bottle. What my - so what I remember was it was flailing and there was definitely wine that was coming out.

102 6:47:34

MS. VASQUEZ: Would you say that being sloppy is different than being combative?

103 6:47:41

ELIZABETH MARZ: Yeah, I would say sloppy and combative are two different things.

104 6:47:45

MS. VASQUEZ: It's your testimony that Mr. Depp was, on May 21st, 2016, both combative and sloppy.

105 6:47:52

ELIZABETH MARZ: Yeah. I would describe that it that there was a little bit of both, but combative and sloppy.

106 6:47:58

MS. VASQUEZ: Was he more sloppy than he was combative?

107 6:48:01

ELIZABETH MARZ: It felt more combative than sloppy.

108 6:48:04

MS. VASQUEZ: Just to clarify, the only thing combative was the words he was speaking?

109 6:48:10

ELIZABETH MARZ: No. Completely the way he entered into the room, rushed in, his energy, the way it felt like he was coming after me, almost felt like, from where I was standing, I felt like he was charging towards me, and I was scared and it was - it felt - it felt, yeah, combative. It felt - I'm trying to look for another word that I could describe what I felt, but it was -yeah, it was scary. My heart was beating really fast, really quickly, and I freaked out.

110 6:48:47

MS. VASQUEZ: Okay. So after you exchanged some text messages with Ms. Pennington, you came out of your hiding spot and then went to Ms. Pennington and Mr. Drew's penthouse; is that correct?

111 6:49:01

ELIZABETH MARZ: Correct.

112 6:49:01

MS. VASQUEZ: So who was in penthouse 1 when you got out of the hiding spot and came to penthouse 1?

113 6:49:07

ELIZABETH MARZ: I mean, it was Josh, Raquel, Amber and I, were the only people that were, at some point, in there during that time.

114 6:49:15

MS. VASQUEZ: Do you remember the first time you saw Ms. Heard after this incident?

115 6:49:20

ELIZABETH MARZ: I remember seeing her after that incident It was in the - that apartment.

116 6:49:23

MS. VASQUEZ: In penthouse 1?

117 6:49:26

ELIZABETH MARZ: Correct.

118 6:49:27

MS. VASQUEZ: So the first time you saw Ms. Heard after this incident, on May 21st, 2016, was in penthouse 1?

119 6:49:34

MS. VASQUEZ: What do you recall seeing -- the first thing you saw when you saw Ms. Heard?

120 6:49:41

ELIZABETH MARZ: I just remember she looked really upset and disheveled, and her hair was a mess, and she had a swollen face. Red She had a red, swollen face.

121 6:49:53

MS. VASQUEZ: Okay. Had you ever seen Ms. Heard cry before May 21st, 2016?

122 6:50:03

ELIZABETH MARZ: I don't think so. Not that I can remember.

123 6:50:09

MS. VASQUEZ: Okay. What side of her face was swollen?

124 6:50:15

ELIZABETH MARZ: I think it was her right side of her face.

125 6:50:20

MS. VASQUEZ: Do you have an independent recollection I j l that it was the right side of her face that was swollen?

126 6:50:26

ELIZABETH MARZ: I'm taking myself back there and trying to remember, like, where I was standing - you know what I mean? Yeah, I think looking at her, it was on my left, and her right side.

127 6:50:38

MS. VASQUEZ: Okay. So let's talk about her hair. Is It seemed disheveled, is that what you said, her hair was disheveled?

128 6:50:42

ELIZABETH MARZ: Uh-huh.

129 6:50:46

MS. VASQUEZ: Was she crying?

130 6:50:48

ELIZABETH MARZ: Yeah, there was definitely tears.

131 6:50:51

MS. VASQUEZ: Was she animated?

132 6:50:55

ELIZABETH MARZ: She was visibly very upset.

133 6:50:56

MS. VASQUEZ: Okay. So "visibly very upset" means what? She was crying?

134 6:50:59

ELIZABETH MARZ: Uh-huh.

135 6:51:02

MS. VASQUEZ: Okay. And what else?

136 6:51:05

ELIZABETH MARZ: Tears, sadness, felt like confusion. Felt like those were the main things.

137 6:51:15

MS. VASQUEZ: What did Mr. Drew say, if anything?

138 6:51:19

ELIZABETH MARZ: I don't remember him saying - what he said I think everybody was just shaken up.

139 6:51:29

MS. VASQUEZ: So soon after you went into penthouse 1, you remember some police officers coming to penthouse 1?

140 6:51:35

ELIZABETH MARZ: I remember - yeah, I remember there were police officers in the hallway, uh-huh.

141 6:51:43

MS. VASQUEZ: Was Ms. Heard icing her face after the incident but before the police arrived?

142 6:51:51

ELIZABETH MARZ: I think so.

143 6:51:52

MS. VASQUEZ: Who gave her the ice?

144 6:51:56

ELIZABETH MARZ: I don't remember.

145 6:52:10

MS. VASQUEZ: So you were in penthouse 1 when the police came.

146 6:52:14

MS. VASQUEZ: How do you know that they came? What did you hear and what did you see?

147 6:52:23

ELIZABETH MARZ: Because it- they said the police are here. So I -

148 6:52:24

MS. VASQUEZ: Who said that?

149 6:52:26

ELIZABETH MARZ: I don't remember. Again, this is a very long time ago, so specific details are going to be really hard for me to remember. I just know knowing that the police were there in the hallway, two of them.

150 6:52:37

MS. VASQUEZ: And in February, when you lived at the penthouse for a few weeks, you didn't hear or see any abuse by Mr. Depp towards Ms. Heard, correct?

151 6:52:52

ELIZABETH MARZ: Correct.

152 6:52:53

MS. VASQUEZ: And did you go to Amber and Johnny's penthouse thereafter or where did you go next?

153 6:53:03

ELIZABETH MARZ: So, I just remember, at some point, ending up - yes, at some point, we were in their penthouse afterwards, in Johnny and Amber's. At some point, we went over there.

154 6:53:13

MS. VASQUEZ: Did you go over there, do you think, after the police came?

155 6:53:16

ELIZABETH MARZ: It was after the first two police officers came.

156 6:53:19

MS. VASQUEZ: Okay. Do you remember glass on the floor?

157 6:53:24

ELIZABETH MARZ: At this point in time, I don't remember what I saw. I don't remember if it was cleaned up by the time I got there or if there was glass on the floor when I walked in.

158 6:53:32

MS. VASQUEZ: Do you remember seeing wine spilled?

159 6:53:35

ELIZABETH MARZ: I recall seeing wine spilled in the hallway, like a lot of wine spilled in the hallway.

160 6:53:41

MS. VASQUEZ: When do you recall seeing the wine spilled in the hallway?

161 6:53:47

ELIZABETH MARZ: At some point in the night, maybe after, you know, before - I recall - I don't recall specifically, but I remember seeing wine spilled in the hallway. I remember that being one of the things that I saw that was part of the destruction of whatever happened

162 6:54:05

MS. VASQUEZ: So the police come and you stayed in penthouse 1?

163 6:54:07

ELIZABETH MARZ: Correct.

164 6:54:09

MS. VASQUEZ: It was after the police officers left that you went to penthouse 3?

165 6:54:14

ELIZABETH MARZ: Correct.

166 6:54:14

MS. VASQUEZ: Where Amber and Johnny lived?

167 6:54:16

ELIZABETH MARZ: Correct. /20

168 6:54:19

MS. VASQUEZ: Do you recall seeing wine spilled in the hallway?

169 6:54:20

ELIZABETH MARZ: I remember seeing wine spilled in the I hallway, yeah.

170 6:54:22

MS. VASQUEZ: Okay. And you saw the wine after the police officers came, correct?

171 6:54:26

ELIZABETH MARZ: I think so.

172 6:54:28

MS. VASQUEZ: Did Ms. Pennington take any photographs ! of the scene?

173 6:54:31

ELIZABETH MARZ: I remember Raquel taking photographs of Amber's face.

174 6:54:35

MS. VASQUEZ: Now, going to your description of Ms. Heard's face, you said it was the right side ! 11 of her face. You said it was, what, swollen?

175 6:54:37

ELIZABETH MARZ: Uh-huh.

176 6:54:40

MS. VASQUEZ: And red?

177 6:54:42

ELIZABETH MARZ: Uh-huh.

178 6:54:45

MS. VASQUEZ: What else?

179 6:54:46

ELIZABETH MARZ: Correct. Yeah, it was swollen and red.

180 6:54:51

MS. VASQUEZ: Was any part of her face more swollen than others?

181 6:54:55

ELIZABETH MARZ: It was around her eye.

182 6:54:58

MS. VASQUEZ: Had bruising developed already?

183 6:55:01

ELIZABETH MARZ: No. It was red and swollen.

184 6:55:04

MS. VASQUEZ: Okay. So you did not see any bruising on Ms. Heard's face the evening of May 21st, 2016, correct?

185 6:55:11

ELIZABETH MARZ: I saw red, swollen, puffy face.

186 6:55:16

MS. VASQUEZ: Okay. And just on the right side, correct?

187 6:55:20

ELIZABETH MARZ: Correct.

188 6:55:21

MS. VASQUEZ: But wasn't it your testimony, Ms. Marz, that you were inside penthouse 1 when the first police officers came to the scene?

189 6:55:33

ELIZABETH MARZ: Correct. Correct.

190 6:55:35

MS. VASQUEZ: And how much time do you estimate they spent in the penthouses?

191 6:55:40

ELIZABETH MARZ: I don't remember. The second group of officers - there's two sets of officers that came. The second set of officers, that, I actually was in the apartment, in PH3, I think it was.

192 6:55:53

MS. VASQUEZ: Did you hear either Ms. Heard, Mr. Drew, or Ms. Pennington cleaning anything that Mr. Depp allegedly destroyed?

193 6:56:05

ELIZABETH MARZ: I don't remember, but I do remember that- I'm pretty sure that Josh was helping to clean up. The more I got - I remember knowing that the place was cleaned up before I entered in there.

194 6:56:20

MS. VASQUEZ: Before you entered in where?

195 6:56:22

ELIZABETH MARZ: Into the main apartment.

196 6:56:24

MS. VASQUEZ: So you recall Josh Drew cleaning up before you entered penthouse 3.

197 6:56:35

MS. VASQUEZ: What was he cleaning up, exactly?

198 6:56:37

ELIZABETH MARZ: I just remember by the time that I had gotten into that apartment, that someone had cleaned up the glass and the wine that had been - that was on the floor.

199 6:56:47

MS. VASQUEZ: Do you recall who told you that penthouse 3 had been cleaned up?

200 6:56:53

ELIZABETH MARZ: I don't - no one specifically told me. What I was expressing is that it was cleaned up before I got there, for the most part. I just remember that, for the most part - I don't remember.

201 6:57:02

MS. VASQUEZ: To clarify, Ms. Marz, when you came into penthouse 3, after the police officers, the first set of police officers came and left, you I did not see silver candlesticks, candelabra sticks broken on the floor, baskets of fruit that had been on the kitchen island, food everywhere, baskets on the ground, containers holding spoons and forks, kitchen utensils spilled, a lamp, a little patchy thing broken in penthouse 5 -- I'm sorry, penthouse 3?

202 6:57:44

ELIZABETH MARZ: No. I'm sort of remembering there was some stuff that had, like, something that had been broken, like the statue things, sounds kind of familiar to me, now that I'm reading this. But I don't remember, when I walked in, if there was - I don't remember this being on the floor.

203 6:58:01

MS. VASQUEZ: Okay.

204 6:58:01

ELIZABETH MARZ: I don't remember seeing it.

205 6:58:03

MS. VASQUEZ: Okay. So you don't remember seeing it?

206 6:58:05

ELIZABETH MARZ: Yeah, I don't remember seeing it. I don't remember. But, again, as I'm reading the stat - when I read the statue, I kinda - it's something like, oh, yeah, I remember there's some - something that was - some things that were broken, but I don't specifically remember what they were.

207 6:58:21

MS. VASQUEZ: You did not witness --

208 6:58:22

ELIZABETH MARZ: I didn't witness, firsthand, anything.

209 6:58:25

ELIZABETH MARZ: I didn't witness, firsthand, Johnny abusing Amber.

210 6:58:30

MS. VASQUEZ: But do you recall testifying to that effect, that Johnny charged at you and that you were scared?

211 6:58:35

ELIZABETH MARZ: He charged towards me and I was scared, and I ran past him.

212 6:58:40

MS. VASQUEZ: You didn't run past him because he told everyone in the penthouse to get out of his penthouse?

ELIZABETH MARZ: I ran past him for - because he was -- because he ran into the unit and it scared the shit out of me because he was wasted and I screaming. So that's why I ran out. If there's a grown-ass man coming at you and saying, "Get your bitch out of here," swinging a magnum-size bottle of wine, I'm sure -- I don't know what anyone do - I can't say what I - anyone would do, but I ran out.

[SECTION HEADER]: EXAMINATION BY COUNSEL FOR THE DEFENDANT AND BY MS. BROOK:

215 6:59:15

BROOK: Would you remind us what side of Ms. Heard's face you recall had marks on May 21st, 2016?

216 6:59:23

ELIZABETH MARZ: The right side of her face.

217 6:59:25

BROOK: Do you feel indebted to Ms. Heard in anyway?

218 6:59:28
219 6:59:29

BROOK: Have you ever done Ms. Beard's makeup?

220 6:59:31
221 6:59:32

BROOK: You testified earlier today that Ms. Heard often, in the times you saw her, would not be wearing makeup; is that correct?

222 6:59:40

ELIZABETH MARZ: Correct.

223 6:59:41

BROOK: Is it possible, in some of those times, that she was wearing the type of makeup we ladies sometimes use to not appear as though we're wearing makeup?

224 6:59:50
225 6:59:51

BROOK: So you wouldn't necessarily be able to tell whether or not she was wearing a basic concealer or foundation?

226 6:59:56

ELIZABETH MARZ: Correct.

227 6:59:57

BROOK: Talking about the loud noises, what did you hear?

228 7:00:00

ELIZABETH MARZ: Yeah. Just screaming, yelling, doors slamming, commotion.

229 7:00:08

BROOK: Could you tell whether the screaming and the yelling was a male voice or a female voice?

230 7:00:14

ELIZABETH MARZ: From what I can remember, male.

231 7:00:21

BROOK: And could you tell where the screaming and the yelling was coming from?

232 7:00:26

ELIZABETH MARZ: It felt like it was coming - started farther down the hallway and then it was coming, like, closer. So essentially - I mean, I don't know, but it could have been the hallway.

233 7:00:41

BROOK: And so after you start hearing the screaming and the yelling and the doors slamming and the commotion, you testified that Mr. Drew got up and went to the door?

234 7:00:46

ELIZABETH MARZ: Uh-huh, yeah.

235 7:00:51

BROOK: What did Mr. Drew do?

236 7:00:53

ELIZABETH MARZ: He was kind of pacing by the door and looking through the peephole.

237 7:01:02

BROOK: And what happened next?

238 7:01:05

ELIZABETH MARZ: And then the door, like, burst open and Johnny came charging in and screamed, again, holding the magnum-size bottle of wine, you know, flailing it around, looked intoxicated, kind of stumbling, and screamed, "get your bitch out of here," as he ran in my direction. And I was I scared. It was very - it was very frightening 111 and, you know, just scary and unexpected. So I just darted out past him and ran up toward the ! 13 pool/gym area and hid there.

239 7:01:49

BROOK: Prior to the night of May 21, 2016, had I a man ever charged at you holding a magnum bottle I ! 16 of wine screaming profanities?

240 7:01:59

MS. VASQUEZ: Objection.

241 7:01:59

BROOK: And what was your reaction to this when it happened on this event of May 21, 2016?

242 7:02:09
243 7:02:14

BROOK: Besides the screaming and the door slamming and the wine waving, do you recall g g, y anything else about Mr. Depp's actions that evening, during that moment, I guess I should say.

244 7:02:37

ELIZABETH MARZ: It was - I would describe it as erratic behavior.

245 7:02:46

BROOK: Was anyone else with Mr. Depp when he charged into penthouse 5? i 7

246 7:02:51

ELIZABETH MARZ: Behind him were two men.

247 7:02:54

BROOK: What about Ms. Heard?

248 7:02:56
249 7:02:57

BROOK: What about Ms. Pennington?

250 7:02:59
251 7:03:01

BROOK: So you testified that after Mr. Depp burst into the apartment and started charging toward you, that you darted out and hid in, I believe you said it's a communal exercise area; is that correct?

252 7:03:15

ELIZABETH MARZ: Yeah. I darted out and went up the stairs and hid somewhere over by there.

253 7:03:21

BROOK: Why did you hide?

254 7:03:23

ELIZABETH MARZ: Because, as I said, I -

255 7:03:24

BROOK: Say it again. Why did you hide?

256 7:03:25

ELIZABETH MARZ: Because I was scared.

257 7:03:27

BROOK: What were you scared of?

258 7:03:28

ELIZABETH MARZ: I just didn't know what he would do. I didn't -- I didn't know what he would do.

259 7:03:35

BROOK: And the "he" there is who?

260 7:03:40

ELIZABETH MARZ: Johnny.

261 7:03:40

BROOK: What were you thinking when you were hiding in the communal exercise area?

262 7:03:48

ELIZABETH MARZ: I don't remember. Just that I was -- I mean, I just remember being scared and not wanting to leave that area until, like, I was clear that there was -- that I wasn't going to be attacked.

263 7:04:03

BROOK: And at some point, did you leave the area?

264 7:04:05
265 7:04:06

BROOK: And what prompted you to leave the area?

266 7:04:09

ELIZABETH MARZ: Text with Raquel, just telling her to come to her and Josh's apartment.

267 7:04:17

BROOK: And did you do as Ms. Pennington said and go to her and Josh's apartment?

268 7:04:23
269 7:04:23

BROOK: Sitting here today, do you remember g y, y what you were thinking as you were sort of coming out of your hiding spot and walking towards the penthouses again?

270 7:04:33

ELIZABETH MARZ: I think the whole thing was just bizarre. Like, really frightening and bizarre to me. I don't specifically remember what I was thinking other than, like, holy shit, what the fuck just happened, you know. And is he gone? Maybe I was thinking that. I don't remember specifically.

271 7:04:56

BROOK: When you say "is he gone," who's the "he" you're referring to there?

272 7:05:02

ELIZABETH MARZ: Johnny.

273 7:05:06

BROOK: When you got to Ms. Pennington and Mr. Drew's penthouse, who did you see? Who was there?

274 7:05:13

ELIZABETH MARZ: I don't remember who was specifically there when I first walked in, but throughout the time being in there, and that moment, definitely Amber, Raquel, and Josh, maybe, like, just by peeping into the hallway, one of the police officers.

275 7:05:37

BROOK: When you saw Ms. Heard, after you came ,2 back down from your hiding spot and you're in Mr. Drew's and Ms. Pennington's apartment, how did she look?

276 7:05:48

ELIZABETH MARZ: She looked frazzled and just completely disheveled. Her hair was all over the place. She had a swollen face. Looks like she's been crying is and, yeah.

277 7:06:06

BROOK: Do you think the swollen face was a result of her having been crying?

278 7:06:10
279 7:06:10

BROOK: What do you think it was a result of?

280 7:06:13

ELIZABETH MARZ: It looked like she had been hit somewhere. It was definitely not from crying. She had markings on her face.

281 7:06:20

BROOK: Were the marks that you saw on Ms. Heard's face, after you came down from your hiding spot, present when you had been hanging out I with her earlier in the day?

282 7:06:30
283 7:06:32

BROOK: You testified earlier today that you witnessed some, I believe it was Ms. Pennington or, g Mr. Drew, take some photos of Ms. Heard's face.

284 7:06:41

BROOK: Do you remember that?

285 7:06:43
286 7:06:44

BROOK: I'd like to mark what will be Marz Exhibit 13. Ms. Marz, as the court reporter hands you Exhibit 13, I'll represent to you that these were some photos taken on the night of May 21st, 2016. So if you turn to the second photo in the set, do you recognize the person in this photograph?

287 7:07:06
288 7:07:07

BROOK: Who is it?

289 7:07:09

ELIZABETH MARZ: Amber. p6

290 7:07:09

BROOK: And do you see any marks on her face in this photograph?

291 7:07:13
292 7:07:13

BROOK: And do these marks look like the marks that you saw in person on her face on the evening of March 21, 2016?

293 7:07:21
294 7:07:23

BROOK: And just to clarify, these marks were not on her face when you saw Ms. Heard earlier that same afternoon and were helping Ms. Pennington with beads?

295 7:07:31

ELIZABETH MARZ: Correct.

296 7:07:32

BROOK: There are other photos in this set. Why don't we tum back to the first one. Some broken frame on a bed.

297 7:07:39

BROOK: Do you know what this picture is of?

298 7:07:43

ELIZABETH MARZ: Yeah. I mean, this is Amber and Johnny's bed, and there's broken - there's photographs on it.

299 7:07:50

BROOK: So I take it that you've seen Amber and Johnny's bedroom before?

300 7:07:53
301 7:07:55

BROOK: Do you recall being let into Mr. Depp's and Ms. Heard's bedroom that night?

302 7:08:00
303 7:08:01

BROOK: No you don't recall, or no you didn't?

304 7:08:03

ELIZABETH MARZ: No, I don't recall.

305 7:08:06

BROOK: The next photo in this set is a picture of Ms. Heard. Just after that, there's a photo, p , bear with me -- of what appears to be a hallway.

306 7:08:15

BROOK: Are you with me?

307 7:08:16
308 7:08:16

BROOK: Do you recognize what this is an image of?

309 7:08:19
310 7:08:19

BROOK: What is it an image of?

311 7:08:21

ELIZABETH MARZ: It's the hallway between all of the penthouse apartments.

312 7:08:25

BROOK: So you've been in th.is hallway plenty oftimes?

313 7:08:28
314 7:08:28

BROOK: Do you see the sort of red staining on the right-hand comer of the page?

315 7:08:33
316 7:08:34

BROOK: Do you recall seeing that red staining on the night of May 21, 2016?

317 7:08:39
318 7:08:39

BROOK: And what was it?

319 7:08:41

ELIZABETH MARZ: It was wine.

320 7:08:42

BROOK: So you saw that staining on the night of May 21, 2016? PIANE

321 7:08:45
322 7:08:46

BROOK: Do you recall whether it was there when you arrived in the afternoon?

323 7:08:50

ELIZABETH MARZ: I don't remember seeing it, no.

324 7:08:51

BROOK: So when was the first time that you remember seeing it?

325 7:08:55

ELIZABETH MARZ: I think when I came out of my hiding spot and came downstairs and back into Raquel and Josh's apartment.

326 7:09:04

BROOK: But you didn't see the wine get spilled?

327 7:09:07

ELIZABETH MARZ: Not this, no.

328 7:09:08

BROOK: You saw other wine get spilled?

329 7:09:10

ELIZABETH MARZ: I saw-- yeah. As he was -- when he came in the apartment, when he was flailing the wine.

330 7:09:18

BROOK: And the "he" there is?

331 7:09:20

ELIZABETH MARZ: Johnny.

332 7:09:20

BROOK: And then the last photo in this set appears to be of some picture frames hanging on the wall; do you see that?

333 7:09:27

ELIZABETH MARZ: Yes, this is Amber and Johnny's I, J y I 1 apartment, I think. But, again, I don't remember if it's in her studio. I don't know.

334 7:09:36

BROOK: Do you recall seeing this photo in one of the penthouses before?

335 7:09:40
336 7:09:41

BROOK: And when you saw it, was it broken?

337 7:09:44
338 7:09:44

BROOK: And what, if anything, do you remember about Ms. Pennington's state?

339 7:09:52

ELIZABETH MARZ: Also distraught, upset.

340 7:09:56

BROOK: You've been friends with Ms. Pennington for many years at that point, correct?

341 7:10:00

ELIZABETH MARZ: Correct.

342 7:10:01

BROOK: Have you ever seen her similarly I distraught?

343 7:10:06

ELIZABETH MARZ: Not similarly. But she was sad.

344 7:10:10

BROOK: But had you ever seen her have the same reaction that she had that evening?

345 7:10:15
346 7:10:17

BROOK: So you also testified that you saw Mr. Drew in his and Ms. Pennington's penthouse. What, if anything, do you remember about Mr. Drew's state?

347 7:10:28

ELIZABETH MARZ: I just remember him being just a grounding energy. Just trying to be supportive to Amber and to Raquel, and just really trying to be, like, the man in the situation that was going to, like, really be grounded amongst women that were sort of, like, frightened, and sort of a little frantic. He was very much ground and very, like, clear. I remember feeling safe with him It was like protection.

348 7:11:00

BROOK: You testified earlier today that "there are some things that I really remember and some things that are a little shaky."

349 7:11:08

BROOK: Which bucket do the marks that you saw on Ms. Beard's face on the evening of May 21, 2016, fall into, the things that were a little shaky or the things that you really remember?

350 7:11:20

ELIZABETH MARZ: That I really remember.
